1. Acceptance of Terms

By accessing our website, visiting our facilities, or entering into a residency agreement with Serenova, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services or website.

These terms apply to all visitors, prospective residents, current residents, family members, and anyone who interacts with Serenova in any capacity.

2. Definitions

For the purposes of these Terms and Conditions:

  • "Serenova," "we," "us," or "our" refers to the senior living community operated at 234/56 Chaengwattana Road, Bangkok, Thailand
  • "Resident" refers to any individual who has entered into a residency agreement with us
  • "Services" refers to all residential services, amenities, and accommodations provided by Serenova
  • "Agreement" refers to the formal residency contract between Serenova and a resident
  • "Website" refers to our online presence accessible through seerenoovass.live

3. Eligibility and Admission

3.1 Age Requirements

Our services are designed for individuals aged 60 years and older. Exceptions may be considered on a case-by-case basis for those aged 55-59 years with appropriate medical or personal circumstances.

3.2 Health and Medical Considerations

Serenova is a non-medical residential community. We do not provide medical care, nursing services, or medical treatment. Prospective residents must be able to live relatively independently or have appropriate outside medical support arrangements. We may request medical information to ensure we can accommodate individual needs appropriately.

3.3 Right to Refuse Admission

We reserve the right to decline admission if we determine that we cannot adequately meet an individual's needs or if acceptance would compromise the safety and wellbeing of other residents.

4. Residency Agreements

4.1 Types of Arrangements

We offer three types of arrangements: Introduction Visits (complimentary), Short-Term Stays (2 weeks to 1 month), and Long-Term Residence (monthly basis). Each arrangement is governed by its specific terms detailed in the individual agreement.

4.2 Agreement Requirements

All residents must sign a written agreement before occupying living space. The agreement specifies fees, services included, duration, termination conditions, and resident responsibilities.

4.3 Modifications

Changes to residency agreements must be made in writing and agreed upon by both parties. We may adjust fees and terms with 60 days written notice.

5. Fees and Payment

5.1 Monthly Fees

Fees are payable monthly in advance and are quoted in Thai Baht (฿). Current rates are ฿28,500 per month for Short-Term Stays and ฿48,000 per month for Long-Term Residence. These fees are subject to change with appropriate notice.

5.2 Included Services

Monthly fees cover living space, utilities, housekeeping, communal dining, activities, and access to facilities. Additional services may incur extra charges as outlined in your agreement.

5.3 Payment Methods

We accept bank transfers and cash payments. Payment is due by the 1st of each month.

5.4 Late Payment

Payments received after the 5th of the month may incur late fees. Continued non-payment may result in termination of residency.

6. Resident Responsibilities

Residents agree to:

  • Respect other residents, staff, and visitors
  • Maintain their living space in reasonable condition
  • Follow community guidelines and posted rules
  • Report maintenance issues and safety concerns promptly
  • Keep personal medical information current and inform staff of significant health changes
  • Arrange for their own medical care and transportation to appointments
  • Respect quiet hours and communal spaces
  • Refrain from behaviors that disturb others or compromise safety

7. Our Responsibilities

Serenova commits to:

  • Maintain facilities in good, safe condition
  • Provide services outlined in residency agreements
  • Treat residents with dignity and respect
  • Protect resident privacy and personal information
  • Address concerns and complaints in a timely manner
  • Maintain appropriate staff levels to support residents
  • Ensure cleanliness and hygiene standards

8. Termination

8.1 By Resident

Long-term residents may terminate their agreement with 30 days written notice. Short-term arrangements conclude at the agreed end date unless extended by mutual agreement.

8.2 By Serenova

We may terminate residency with 30 days notice if: fees remain unpaid after reasonable notice, resident behavior poses safety concerns, resident's medical needs exceed our non-medical capabilities, or there is serious violation of community rules.

8.3 Effect of Termination

Upon termination, residents must vacate their living space and remove personal belongings. Prorated refunds or charges will be calculated based on actual days of residence.

9. Limitation of Liability

Serenova is a residential community, not a medical facility. We are not liable for medical emergencies, health complications, or injuries except where caused by our negligence. Residents and their families accept responsibility for healthcare decisions and arrangements.

We are not responsible for loss or damage to residents' personal property except in cases of our negligence. We recommend residents maintain appropriate insurance coverage.

To the extent permitted by Thai law, our total liability for any claim shall not exceed the amount of fees paid by the resident in the preceding six months.

10. Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Serenova and protected by Thai and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Privacy

Your use of our services and website is also governed by our Privacy Policy, which explains how we collect and use personal information. Please review our Privacy Policy for details.

12. Governing Law and Disputes

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or your residency shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

Before pursuing legal action, we encourage parties to attempt resolution through informal discussion and, if necessary, mediation.

13. Changes to Terms

We may modify these Terms and Conditions from time to time. Updated terms will be posted on our website with a revised date. For current residents, significant changes will be communicated with appropriate notice. Continued residency after notice of changes constitutes acceptance of the modified terms.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
